SALEM, Ore. — The Oregon Department of Agriculture (ODA) has amended Oregon Administrative Rule (OAR) 603-057-0006, the regulation that establishes annual pesticide product registration fees.
The amended rule, which has an effective date of September 21, 2022, increases the annual fee from the current per-product fee of $320 for calendar year 2022 registrations to a fee of $360 per product beginning for calendar year 2023 registrations. The amended rule also makes the fee nonrefundable beginning with 2023 pesticide product registrations.
Amended OAR 603-057-0006 reads as follows:
Pesticide Registration Fees
(1) The annual registration fee for each pesticide product for calendar year 2022 shall be
$320.
(2) Beginning for calendar year 2023 pesticide product registration, the annual nonrefundable registration fee for each pesticide product shall be $360.
Background: House Bill 3549 (2015) increased the statutory maximum for annual
pesticide registration fees to $400 to help fund staffing increases in the Pesticides
Program that were also established in the legislation. For the 2016 registration year, ODA determined that the fees needed to be increased to only $320. However, due to increased program responsibilities and expenses since that time, increased funding will now be required beginning in 2023. In setting the fee at $360 per product in the new rule amendment, ODA again determined that the full amount of the cap is not needed at this time to maintain current service levels, but did make the fee nonrefundable in order to increase efficiencies and reduce agency time spent on noncompliant registration applications.
ODA will be providing additional information to pesticide registrants concerning this fee increase.
