NEW YORK — On April 5, 2017, a Kansas City federal judge dismissed the lone legal claim on which the national class action was based. As a result there no longer is a national class action protecting the rights of New York corn producers who chose to stay in the class and not opt out. At this juncture, the only way that New York Corn farmers can protect their interests in the Syngenta corn matter and share in any recovery is to hire a lawyer and file an individual case.
Every New York farmer who has grown corn for market since 2013 has been damaged and has a claim that they may make to recover money damages from Syngenta. This is the case even if they did not plant Syngenta corn because, in China’s eyes, Syngenta’s actions tainted the entire U.S. corn crop.
THE SYNGENTA CORN MATTER IN A NUTSHELL
In late 2010, Syngenta began selling a new GMO corn seed-Agrisure Viptera, and later, Agrisure Duracade – containing the MIR 162 trait before it was approved by China. China ultimately detected MIR 162 in U.S. corn shipments in November 2013. As a result, China, the third-largest
U.S. corn export market at the time, embargoed U.S. corn – thereby driving down corn prices and damaging New York corn producers. The U.S. corn market has not fully recovered.
